If you are serious about giving in, have a conversation about what would happen if there is something medically wrong with hypothetical baby, or special needs. Be on the same page about what would happen. Sounds harsh, but better to be prepared, IMO.

I mean my initial reaction was “you really think he’s sleeping with her with your mother and children in the house? Really?” So that could be a reason for the defensiveness. It seems so ludicrous and bold to try something like that, if I was accused of it I’d be livid and I don’t tend to be a highly emotional or angry person. Beyond being accused of an affair, that my partner might actually be considering I’d hook up with someone while their mother and our children were in the house adds an entirely new level of wtf. Also yes just asking about the perfume does sound accusatory. Since it sort of gives the sense that you went in their sniffing around trying to find something wrong. Not saying you did, it might just be very strong. But I could see it coming across that way.
I would say talk to your mom alone since she’s around them alone and see if she thinks there is anything suspicious. Or come back having “forgot” something or not feeling well, while they’re supposed to be working out. I don’t know if he’s cheating or not, but either of those things wouldn’t be tank the relationship level of suspicion if you’re wrong. Recording/filming and going through his phone can ruin a relationship if they find out and they’ve done nothing wrong.
I so strongly hope that the judge sees how insane this whole thing is and that you lose the case .
